PhD Defense Gaetano Best

15 September 2016

On Thursday, 20 October 2016 (12:00), Gaetano Best will publicly defend his thesis entitled 'Fair and Accurate Fact-finding in Dutch Atrocity Crime Cases'.

Abstract

The International Crimes Act (ICA), which was enacted in 2003, creates universal jurisdiction to adjudicate cases involving allegations of genocide, war crimes, crimes against humanity, torture and forced disappearances. The Dutch authorities have put a great deal of effort into building a specialised domestic infrastructure that is capable of investigating and adjudicating atrocity crimes, but there are a number of problems courts have been faced with. Gaetano Best examines the adjustments Dutch courts have made to the practice of Dutch criminal procedure to overcome the evidential limitations of atrocity crimes cases to ensure fair proceedings and accurate fact finding. He analyses the changes that Dutch criminal procedure has undergone in terms of evaluating the evidence of international witnesses and facilitating defence participation in the evidence gathering of atrocity crimes cases.
