Contractual Limitation of Liability Clauses (CLLCs) is a traditional instrument of the law of contract, regulating the prospective liability of the parties in case of a breach of their contractual obligations. CLLCs have received universal recognition across different legal systems. The universal recognition of CLLCs in comparative private law leaves open the question of their recognition in other areas of law. Other disciplines may interact with private law mechanisms as a part of the applicable law or use them by way of analogy to regulate similar phenomena. The paper focuses on the use of CLLCs in international investment law and arbitration.
